Chemicals: EU Enacts New Regulation for Fluorinated Greenhouse Gases

On February 20, 2024, the EU enacted Regulation (EU) 2024/573 on fluorinated greenhouse gases.

The regulation:

  • Lays down rules on the containment, use, recovery, recycling, reclamation and destruction of fluorinated greenhouse gases, and other measures;
  • Imposes conditions on the production, import, export, placing on the market, subsequent supply, and use of fluorinated greenhouse gases, and of specific products and equipment containing fluorinated greenhouse gases or whose functioning relies upon those gases;
  • Imposes conditions on specific uses of fluorinated greenhouse gases;
  • Establishes quantitative limits for the placing on the market of hydrofluorocarbons;
  • Establishes rules on reporting.

Annexes I, II, and III list the fluorinated greenhouse gases, whether alone or as mixtures, to which this regulation applies to.

Furthermore, Annex IV establishes the list of products and equipment containing fluorinated greenhouse gases prohibited from being placed on the market. This includes, among others:

  • Refrigerators and freezers;
  • Air-conditioning equipment;
  • Fire-protection equipment;
  • Footwear;
  • Foams;
  • Aerosols;
  • Personal care products. (e.g., mousse, creams, foams, liquids, or sprays)

The dates for when the prohibition starts is listed in this Annex.

This regulation repeals Regulation (EU) 517/2014 on fluorinated greenhouse gases. It shall enter into force on March 11, 2024. Some articles shall apply on later dates as indicated in Article 38.
