California Approves Bill Prohibiting Bisphenol on All Juvenile Feeding Products

On September 27, 2024, Governor Gavin Newsom approved a bill that expanded California’s existing prohibitions and requirements on bisphenol A to include all juvenile feeding products and juvenile sucking or teething products. Prior to this bill, only bottles or cups designed or intended to be filled with liquid, food or beverage intended primarily for consumption by children 3 years of age or younger that contained specified amounts of bisphenol A were subject to restrictions.

The new legislation prohibits the sale of any children's feeding or sucking/teething product that contains any form of bisphenol above a specific threshold, known as the practical quantitation limit (PQL). This threshold will be determined by the Department of Toxic Substances Control. The ban applies to products intended for children under 12 years of age, expanding the protection beyond the previous age limit of 3 years.

This will not apply to medical devices or to food and beverage containers designed or intended primarily to contain liquid, food or beverages for consumption by the general population.

The law shall take effect on January 1, 2026.
