Consumer Products: Canada Sets New Reporting Rules for PFAS Users and Importers

The Canadian Government’s Minister of the Environment published a notice requiring manufacturers, importers and users of certain types PFAS to submit a report by January 29, 2025, for activities conducted during the 2023 calendar year. This is intended to assess the toxicity of the PFAS listed in Schedule 1 of the Notice and to determine if and how these substances should be controlled.

Only Canadian entities (PFAS manufacturers, importers and users) are required to file a report. Foreign suppliers are not subject to the notice, although Canadian customers and/or importers of record may be liable if they exceed the quantity thresholds. Section 2 of the Notice details the criteria, while Section 5 excludes certain uses of PFAS as a mixture or in finished products.

The reports may be submitted to the online reporting system available through Environment and Climate Change Canada’s Single Window.
