On April 9, 2024, the National Health Surveillance Agency published RDC No. 854 providing for the sanitary requirements applicable to packaging, coatings, utensils, lids, and metallic equipment intended to come into contact with food. This Resolution incorporates MERCOSUR Resolution 48/2023.
To ensure that packaging, coatings, utensils, lids, and equipment composed of metallic materials (‘metal FCM’) are safe for consumers, the Resolution establishes that:
- Metal FCM must not leach harmful substances into food and not cause unacceptable changes to the composition of food or its sensory characteristics;
- Construction of metal FCM must adhere to the Resolution’s requirements;
- More than 1% of impurities consisting of lead, arsenic, cadmium, mercury , and antimony considered together must not be present in levels of more than 1% in metal FCM;
- Contaminant metals should not migrate in quantities exceeding the limits established in the technical regulations on inorganic contaminants in food.
It also provides a list of raw materials and migration limits that may be used in the manufacture of metal FCM.
The Resolution shall be enforced starting May 2, 2024, with a 180-day grace period for industry players to comply.
