Ukraine Announces CLP Technical Regulation

The law establishes the basics of hazard classification and general rules for labeling chemical products with hazard information.

Technical Regulation (TR) on hazard classification, labelling and packaging of chemical products prepared by Ministry of Environmental Protection and Natural Resources of Ukraine was approved by the Ukrainian Government on May 10, 2024. Until recently, in Ukraine, there were no rules or criteria for the classification of hazards, labeling and packaging of chemical products by market participants. The law establishes the basics of hazard classification and general rules for labeling chemical products with hazard information. Importantly, it significantly improves the overlap of national legislation with European/international legislation in this area: the technical regulation fully harmonizes Ukrainian legislation in the relevant field with EU legislation (Regulation No. 1272/2008, EU CLP) and UN international standards (GHS system).

The effect of this Technical Regulation applies to chemical products that are provided on the market of Ukraine or produced there: chemical products, substances and mixtures cannot be introduced onto the Ukrainian market if they do not meet the requirements of this TR. In order to carry out the hazard classification of chemical products, manufacturers, importers and other suppliers must “collect all available information on the hazardous properties of chemicals from any reliable sources, evaluate its validity and apply to the selected information the hazard classification criteria for all classes, differentiations and categories within the class, determined by the Technical Regulations.”

It is worth noting that the requirements of this Technical Regulation do not apply to:

  1. radioactive materials;
  2. chemical products that are under customs control, in the event that they are temporarily stored in free customs zones or in warehouses for the purpose of re-export or transit, and are not amenable to processing or processing;
  3. non-isolated intermediate chemical substances;
  4. chemical products that are intended for controlled use only in scientific (scientific and technical) works, and which are not available on the market of Ukraine;
  5. waste.

Also, the requirements of this Technical Regulation generally do not apply to chemical products in a “finished state, intended for use by the final consumer.” For instance, this can be medical devices or cosmetic products, among others.

This Decree shall take effect on June 29, 2024, except for Section 3 (“informing about danger by labeling chemical products with information about danger”) and clauses 135 – 138 of Chapter 6 (“development of emergency medical aid measures in case of damage by chemical products”) of these Technical Regulations, the provisions of which enter into force on January 1, 2025.

Important dates and deadlines

  • January 1, 2025: Technical Regulations enter into force
  • May 1, 2025: substances need to be classified and labelled according to Ukraine CLP, substances placed on the market before that date need to be classified before November 1, 2026
  • May 1, 2026: mixtures need to be classified and labelled according to Ukraine CLP, mixtures placed on the market before that date need to be classified before May 1, 2028
