Consumer Products: UK Removes Expiry Dates of CE Marking and EU Conformity in Certain Products

Effective through the Product Safety and Metrology Etc. (Amendment) Regulations 2024 (S.I. No. 696 of 2024) as of October 1, 2024.

Effective through the Product Safety and Metrology Etc. (Amendment) Regulations 2024 (S.I. No. 696 of 2024) as of October 1, 2024;

  • The expiry date of the recognition of certain European Union (EU) requirements relating to goods, including the CE mark, which is due to end on December 31, 2024, is revoked and the associated transitional provisions are removed;
  • The expiry provision and the associated transitional provisions are replaced with a provision that recognizes EU testing or conformity assessment procedures.

This will mean that, where manufacturers have undertaken conformity assessment procedures with EU recognized bodies, the United Kingdom Conformity Assessed (UKCA) marking is not required, and the relevant EU conformity marking (e.g., CE mark) can be used.

This approach provides businesses with flexibility and choice as they comply with regulations. They can choose to follow either EU requirements (including use of the CE or reversed epsilon markings) or UKCA requirements (including the UKCA marking) for the product regulations included within the scope of this Statutory Instrument.

These updates allow the continued recognition of EU requirements, conformity assessment procedures and marking for products covered by the following regulations:
