El Salvador Adopts GHS for Classification and Labelling

Another Latin America country has implemented GHS for chemical hazard communication looking towards enhancing chemical safety. On January 29, 2025, El Salvador published Decree 1 establishing rules for the distribution and storage of chemical substances in their nation.

On January 29, 2025, the Ministry of Environment and Natural Resources (MARN) of El Salvador published Executive Decree No. 1 of January 13, 2025. The Executive Decree outlines the Technical Rules for the Introduction, Distribution, and Storage of Substances in accordance with the Globally Harmonized System of Classification and Labeling of Chemicals (GHS). This is a significant step towards a sound chemical management program for the country, as it enhances workers’ safety, improves product compliance and better aligns with global standards, which facilitates international trade.

Chemical substances and mixtures within El Salvador will now be required to have Safety Data Sheets (SDS) and labels according to the Sixth Edition of the United Nations Globally Harmonized System of Classification and Labelling of Chemicals (GHS).

The requirements apply to all entities involved in the introduction, distribution, and storage of chemical substances, including manufacturers, importers, distributors, and storage facilities.

The Executive Decree outlines the responsibilities of relevant government agencies enforcing the regulations and ensuring compliance. For chemical importers, the update of labels and Safety Data Sheets must be done whenever there is new information that modifies the hazard classification or within a period of no more than 5 years.

Importers of chemical products will have a maximum period of three years from the entry into force of this Decree to adapt their labels and the SDS.

Recommended action items

If your company currently places chemicals in El Salvador, or plans to do so, or if it is involved in the storage or distribution process of chemicals, ensure you are aware of the obligations and requirements provided in this Decree.
