EU Publishes the 21st ATP to the CLP Regulation

The 21st ATP to the EU CLP Regulation was published on Jan. 5, 2024. It contains a new list of harmonized substance classifications which will be legally enforced beginning on Sept. 1, 2025.

The harmonized classification and labelling of hazardous substances included in Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures (CLP) is updated regularly through an "Adaptation to Technical Progress (ATP)." The latest ATP, 21st ATP, was published on January 5, 2024 in the Official Journal of the European Union with the name “Commission Delegated Regulation (EU) 2024/197 of 19 October 2023 amending Regulation (EC) No 1272/2008 as regards the harmonised classification and labelling of certain substances.”

The EU adopted a series of harmonized substance classification changes proposed between March 2021 and November 2021 in the 21st ATP. The newest ATP contains 28 new additions and 24 amendments, but no deletions. Some substance classifications also include specific M-factors, specific concentration limits and substance ATE values as part of the overall classification.

This ATP will enter into force on January 25, 2024; however, the new classifications will become effective on September 1, 2025. Note that suppliers may classify, label and package substances and mixtures in accordance to the new classifications before the effective date.
