On February 27, 2025, the European Union issued the amended draft of the Toy Safety Regulation (C/2025/1032) repealing the Toy Safety Directive 2009/48/EC.
The draft proposes the following:
- To amend the requirements for chemical substances and expand the ban on toys containing substances classified as carcinogenic, mutagenic or toxic for reproduction.
- To introduce the Digital Product Passport requirement for manufacturers, including unique identifiers and data carrier requirements to enhance traceability.
- To improve warning requirements by emphasizing the visibility of warnings and insertion of digital instructions.
- To mandate the use of the Safety Business Gateway from Regulation (EU) 2023/988 for reporting noncompliance of toys.
The draft aims to improve safety requirements, focusing on children’s psychological and mental health, well-being and cognitive development, particularly regarding digitally connected toys.
This Regulation will take effect 20 days after it is published in the Official Journal of the European Union. A proposed transitional period of 30 months will follow the Regulation’s entry into force. Toys that comply with the Toy Safety Directive and are placed on the market before its repeal may remain on the market until the first day of the month that is 50 months after the Toy Safety Regulation goes into effect.
